Society’s Executive Committee votes to appeal

The Society’s Executive Committee today voted unanimously to appeal the December 19 decision issued by Judge Michael Nowakowski granting summary judgment to the State in Wisconsin Medical Society, Inc. and David Hoffmann, MD, vs. Michael Morgan. The Society is optimistic that the appellate court will protect the integrity of the Injured Patients and Families Compensation Fund (Fund) by reversing the trial court’s decision and ordering the return of the $200 million that the State transferred from the Fund, along with accrued interest.

The Society anticipates filing its appeal within the next few weeks. Once the appeal is filed, the appellate process might take a year or longer before the case is finally resolved. The Society will continue to provide updates regarding the status of the case through Medigram and via the Web site, which includes copies of important documents in the case.
